Terms and Conditions

Te Haerenga o Ngāi Tai ki Tāmaki, trading as Tapuwae Tours ("Tapuwae Tours", "we", "us", "our"), provides guided outdoor experiences on Rangitoto and Motutapu Islands designed to be friendly, enjoyable, engaging, safe and memorable. Please take a few minutes to read these Terms and Conditions carefully before completing your booking. They contain important information, if anything is unclear, please contact Tapuwae Tours before making a reservation.

Risk Disclosure and Liability Waiver

Prior to arrival at the scheduled check-in for your activity, you are required to read our Risk Disclosure, and read and sign our Liability Waiver. You will not be permitted to participate in our activities unless the Risk Disclosure is read and the Liability Waiver is read and duly completed and signed.

Participation Requirements

Our activities have minimum age, fitness and health requirements. It is your responsibility to ensure that you meet all eligibility criteria before booking.

Age

Our activities are available to those 12 years of age and over (and minimum height of 155cm (5'1) for eBike Tours). Participants under 18 years of age must be accompanied by a parent or guardian properly authorised to agree to these Terms and Conditions and Risk Disclosure, and sign the and Liability Waiver form on that minor’s behalf.

Height

Participation in our eBike Tours requires all individuals to meet a minimum height requirement of 155cm (5'1). No refunds will be provided if this requirement is not met.

Fitness and Experience

All participants need to be of reasonable fitness, and have the relevant experience (where required), to participate in our activities.
·       Guided Walk: Participation involves 8km (approximately) walk along designated walking tracks and is of moderate consistent gradient on uneven, loose scoria, and hardpack surfaces and may at times be wet and slippery.
·       Guided e-Bike: Participation involves a 25km (approximately) ride and 5km (approximately) walk along designated walking tracks, island roads and unformed tracks and includes parts with moderate consistent gradient on uneven, loose scoria, gravel and hardpack surfaces and may at times be wet and slippery. To participate in this activity, you must meet our minimum height requirement of 155cm (5'1), have experience biking and be able to display confidence and control on an e-Bike.

We reserve the right to decline participation where fitness and experience concerns exist.

Health

Participants must be in sufficient physical condition to safely participate in our activities. If you are pregnant, have any medical, physical or mental health condition, injury, illness, or are taking any medication that may affect your balance, mobility, endurance, judgement, or ability to safely participate, you must advise us before booking or participating. We may require further information, including medical clearance from a suitably qualified healthcare professional, where reasonably necessary to assess whether the activity can be undertaken safely. Any medical, physical, or mental health condition, injury, illness or medication that affects your ability to safely participate may increase the inherent risks of the activity and your risk of injury or illness. Participants must read our Risk Disclosure and disclose any relevant medical conditions on our Liability Waiver before participating. Where reasonably necessary, we may require additional information or written medical clearance from a suitably qualified healthcare professional. If you are unsure whether this activity is suitable for you, please contact us before booking. We reserve the right to decline participation where we reasonably believe it would present an unacceptable health or safety risk to the participant, other participants, or our guides.

Medical Treatment

You consent to receive any medical treatment which may be deemed necessary in the case of injury, accident or illness suffered while participating in our activities and to indemnify us against any claims in respect of such treatment.

Alcohol and Drugs

We reserve the right to refuse participation to any individual we reasonably believe to be affected by alcohol or drugs (including prescription medication that results in impairing), and in such circumstances no refund will be provided.

Clothing

Our activities are in a variable outdoor environment; you must plan and dress accordingly with suitable clothing and gear. Regardless of conditions we recommend:

·       Sturdy walking or sports shoes (must be closed-toe shoes - no sandals, jandals / flip flops, high heels or other open or loose footwear)
·       Quick dry shorts or trousers (no denim or heavy cotton)
o shorts for e-Bike tours are easier for wearing knee pads (provided)
·       Warm base layer and / or quick dry shirt (no denim or heavy cotton)
o short-sleeve for e-Bike tours are easier for wearing elbow pads (provided)
·       Warm windbreaker top (no denim or heavy cotton)
·       Rain jacket
·       Sun hat
·       Sunglasses
·       Sunscreen and personal medications
·       Phone / camera
·       *Swimwear and towel – optional and pending time, weather and tides
·       Day backpack
o guided walk participants are required to bring a suitable day backpack to carry personal items
o guided e-Bike participants are provided a pannier bag on the e-Bike

Guide Instruction

You agree to follow your guide’s instructions at all times and to ensure that any participant under 18 years of age in your care does the same. Participants must remain on designated walking tracks and cycling routes unless otherwise directed by their guide. We reserve the right to remove or exclude any participant who fails to follow guide instructions, acts recklessly, behaves in a manner that compromises the safety or enjoyment of others, or otherwise poses an unacceptable safety risk.

Pricing and Payment

All prices are quoted and payable in New Zealand Dollars (NZD) and include applicable taxes unless otherwise stated. Full payment is required at the time of booking. Payment will be made online by credit card (Visa or MasterCard). Where payment processing fees apply, these will be displayed at the time of payment and form part of the final transaction cost. Any bank or card processing surcharge is non-refundable in the event of a cancellation or refund. Special offers, discounts, and promotional rates are calculated from the standard retail price and may be subject to specific conditions. We reserve the right to amend advertised prices, products, or promotions at any time before a booking is confirmed.

Weather and Activity Modifications

We operate in a dynamic sea and island environment, and your safety is our highest priority. For safety reasons, we may need to delay, change to the route, or make other operational changes to the activity, this may occur without notice. Any modifications will still deliver a full-length experience, unless for safety or logistical reasons this is not achievable. By booking, you acknowledge and accept that such changes may occur. Route or operational changes made for safety, operational or weather reasons do not entitle participants to a refund unless we cancel the activity.

Check-In and Reporting Times

Participants must arrive at the designated check-in location by the specified check-in time. Participants are responsible for reviewing their booking confirmation and ensuring they arrive with sufficient time to complete check-in procedures. Late arrival will result in forfeiture of the booking without refund.

Accessibility and Participants with Disabilities

We are s is committed to making our activities as inclusive as reasonably possible while maintaining safety standards. Because our activities involve specific physical and operational requirements, participation by individuals with disabilities or impairments will be assessed on a case-by-case basis. We reserve the right to decline participation where we reasonably believe the activity presents an unacceptable safety risk.

Baggage and Other Belongings

You may not participate in the activity with loose items carried on your person (such as handbags, excess, loose or inappropriate clothing, *phones/cameras, tablet or laptop devices) as these may fall, be dropped, become entangled, a danger or be lost. Guided Walk participants are required to bring an applicable day backpack to carry personal items. Guided e-Bike participants are supplied with a pannier bag on their e-Bike to carry personal items. There are no lockers or storage facilities on the islands, we are not responsible for storing excess or unneeded items or for the loss or damage of personal items.

*We encourage you to take and share photos and video of your activity experience, but for your safety we request this done when stopped and stationary, not while walking or biking.

Smoking and Vaping

Smoking and vaping are strictly prohibited during all Tapuwae Tours activities.

Rubbish

Rangitoto and Motutapu Islands are conservations reserves; there are no rubbish bins, anything you bring onto the island’s you must take back off with you.

Gift Vouchers
·       Cannot be exchanged for cash.
·       Cannot be resold or transferred.
·       May not be used in conjunction with other promotions unless specifically stated.
·       Are only valid for the person stated - valid identification is required upon redemption.
·       Are valid for twelve (12) months from the date of issue unless otherwise stated.

Bookings made using gift vouchers remain subject to our standard cancellation and changes policies.

Photography and Video

We may capture photographs and video recordings during your activity.

Your Personal Use

Any images or recordings purchased or supplied to you are intended solely for personal, non-commercial use. They may not be sold, licensed, distributed commercially, or used in advertising, sponsorship, or promotional campaigns without our prior written permission. While we endeavour to capture every participant's activity, we do not guarantee that photo or video products will always be available or meet individual expectations.

Our Tapuwae Tours Use

By participating in our activities, you acknowledge that photographs or video may be taken during the activity for promotional, educational and operational purposes. If you do not wish to be identifiable in promotional material, please advise us before the activity and we will make reasonable efforts to accommodate your request. Rights for us to use any photography and video captured during your activity apply globally and across all media formats, whether currently existing or developed in the future, and no payment or further consent will be required. We encourage you to take and share photos and video of your activity but for your safety we request this done when stopped and stationary, not while walking or biking.

Liability

To the maximum extent permitted by New Zealand law, Tapuwae Tours (including its officers, employees, contractors, volunteers, and agents) accepts no liability for any indirect, incidental, consequential or economic loss arising from your participation in an activity. Nothing in these Terms and Conditions excludes, restricts or limits any rights or remedies that cannot lawfully be excluded or limited under New Zealand law. Participants acknowledge that our activities involve inherent risks, including personal injury, illness, property damage, delays, weather-related disruption and other circumstances beyond our reasonable control. Tapuwae Tours is not responsible for delays, cancellations or interruptions caused by circumstances beyond our reasonable control, including adverse weather, natural events, transport disruptions or government actions. To the extent permitted by law, our total liability arising from your booking or participation is limited to the amount paid for the relevant activity.

Waiver

As a condition of participation, participants must read, complete and sign our Liability Waiver before commencing any activity. Participants under the age of 18 years must be accompanied by and have the Liability Waiver completed and approved by a parent or legal guardian. Failure to complete required documentation will result in participation being refused.

Jurisdiction / Governing Law

These Terms and Conditions, our Risk Disclosure and Liability Waiver are governed by and construed in accordance with New Zealand law. You agree to submit to the exclusive jurisdiction of the courts of New Zealand with respect to any dispute between the parties, claim or matter arising out of or in connection with participation in Tapuwae Tours activity and these Terms and Conditions.

Cancellations and Changes

Our standard cancellation policy applies unless otherwise specified at the time of booking.

Cancellation / changes by you:
·       Cancellations made more than 48 hours before your scheduled check-in time = full refund, excluding any non-refundable bank or payment processing fees.
·       Cancellations made less than 48 hours before your scheduled check-in time = no refund.
·       No-shows, if you do not arrive at or are late for your scheduled check-in time = no refund.
·       Changes made to the date or time of your activity more 48 hours before your scheduled check-in time:
o   1 change = no charge
o   More than 1 change = $25 per person
·       Changes made to the date or time of your activity less than 48 hours before your scheduled check-in time: $50 per person
·       Changes made to the date or time of your activity are subject to availability, we reserve the right to decline booking change requests where operational constraints prevent rescheduling.
·       Any subsequent cancellations or amendments will be subject to the cancellation and amendment charges set out in these Terms and Conditions

Cancellation / changes by us:
·       In the event that we cancel an activity you will be offered either a booking transfer to an alternative date and / or time or a full refund, excluding any non-refundable bank or payment processing fees.
·       We reserve the right to cancel, postpone or vary any activity where reasonably necessary for safety, operational, weather or other circumstances beyond our reasonable control.
·       We will use all reasonable endeavours to contact you in sufficient time to notify of any cancellation.
·       We are not liable in any circumstances for any costs incurred by you as a result of such a cancellation.

Final Acknowledgement, Declaration and Assumption of Risk

By booking and participating in a Tapuwae Tours activity, you acknowledge and agree that:
·       I have read, understood and agree to the Terms and Conditions.
·       I have read, understood and agree to the Risk Disclosure.
·       I understand and accept the inherent risks associated with participation.
·       I choose to participate voluntarily and at my own risk.
·       I understand and accept the cancellation and refund policies stated in these Terms and Conditions.
·       If I am booking on behalf of a participant aged 12 to 18 years of age, I confirm that I am their parent or legal guardian and consent to their participation.
·       I have truthfully disclosed any relevant physical or mental medical conditions, injuries, disabilities or impairments.
·       I understand that physical or mental medical conditions, injuries, disabilities or impairments may increase my risk.
·       I understand that some conditions may require medical clearance before participation.
·       I consent to receiving emergency medical treatment if required during or following participation.
·       I acknowledge that New Zealand's Accident Compensation Scheme (ACC) provides limited coverage and that I remain responsible for obtaining any personal travel, medical, or income protection insurance I consider necessary.
·       I accept that weather, natural hazards, environmental conditions, and other factors beyond Tapuwae Tours control may affect the activity.
·       I accept that Tapuwae Tours may postpone, cancel, modify or refuse my participation where reasonably necessary for safety, operational or environmental reasons.
·       I confirm that I am not under the influence of alcohol, illegal drugs, medication or any substance that may impair my ability to participate safely.
·       I agree to comply with all safety instructions, direction and operational requirements issued or given by Tapuwae Tours and its staff.
·       I will correctly use all required safety equipment.
·       I understand that photograph and video of my participation may not always be available or of expected quality, and that Tapuwae Tours can use these photos and videos for
promotional, educational and operational purposes.
·       Subject to applicable law, I accept all risks associated with participation and release Tapuwae Tours from any liability arising from my participation.
·       Tapuwae Tours is not responsible for circumstances beyond its reasonable control.
·       These Terms and Conditions are governed by the laws of New Zealand, and any legal proceedings must be brought within New Zealand.
